This Policy applies to dealers, merchants, and other business users (“Dealers”) who use QuixChex. It does not govern the privacy practices between Dealers and their customers.

1. Scope and Role of QuixChex

QuixChex provides billing and payment scheduling software.

QuixChex:

• Acts as a service provider to Dealers

• Does not act as a bank, payment processor, or consumer-facing financial institution

• Does not establish a direct relationship with Dealers’ customers

Dealers are solely responsible for providing required privacy disclosures to their customers and obtaining all necessary consents.

2. Information We Collect

2.1 Dealer Information

We may collect information provided directly by Dealers, including:

• Business name, address, and contact information

• Authorized user names, emails, and credentials

• Billing, subscription, and account management data

• Communications with QuixChex support or compliance teams

2.2 Customer Information (Provided by Dealers)

Dealers may upload or input customer data into the platform, including:

• Customer names and contact details

• Invoice and billing information

• ACH-related data (e.g., bank routing and account numbers)

QuixChex processes this data solely on behalf of the Dealer and in accordance with the Dealer’s instructions.

2.3 Technical and Usage Information

We may automatically collect:

• IP addresses and device identifiers

• Browser or application metadata

• Log files, timestamps, and usage activity

• Error reports and performance metrics

This data is used for security, monitoring, and service improvement.

We do not sell personal information.

4. ACH and Financial Data Handling

• QuixChex does not store full bank account details unless required for operational purposes

• Sensitive financial data is handled using reasonable administrative, technical, and organizational safeguards

• Payment information may be transmitted to third-party processors or financial institutions as directed by the Dealer

Dealers are responsible for ensuring that all ACH data is lawfully collected and authorized.

• With payment processors, financial institutions, or sponsor banks as required to provide the Services

• With service providers performing functions on our behalf (e.g., hosting, analytics, security)

All disclosures are limited to what is reasonably necessary.

Dealers are responsible for maintaining their own data retention and deletion policies for customer data.

However, no system can be guaranteed to be completely secure, and use of the Services is at the Dealer’s own risk.

Dealers agree that they are solely responsible for:

• Providing privacy notices to their customers

• Obtaining all required consents and authorizations

• Responding to customer data access, correction, or deletion requests

• Ensuring compliance with applicable privacy and data protection laws

QuixChex has no direct obligation to Dealers’ customers.

QuixChex operates in alignment with applicable data protection and financial compliance requirements, including obligations imposed by:

• Sponsor banks and ODFIs

• Payment processors

• Applicable federal and state laws

We may update practices as required to maintain compliance.

Continued use of the Services after changes become effective constitutes acceptance of the revised Policy.
